0. Who we are

PepsMartUSA is a trade name of Otab Limited Liability Company, a Delaware limited liability company with its registered address at 2810 North Church Street, Wilmington, DE 19802 (support@pepsmartusa.com). "We" and "us" in these terms mean Otab Limited Liability Company.

1. The products

All products sold by PepsMartUSA are chemical reference materials intended strictly for in-vitro laboratory research and analytical use. They are not drugs, dietary supplements, foods, or cosmetics; they are not for human or animal consumption, diagnostic use, or the treatment, mitigation, or prevention of any disease or condition; and they are sold without any express or implied fitness for such purposes.

2. Purchaser attestation

By placing an order you represent and warrant that you are at least 21 years of age; that you are purchasing solely for lawful research purposes; that you (or the institution you represent) have the training and facilities to handle research chemicals safely; and that you will not use, resell, or distribute products for human or animal consumption.

3. Right to refuse

We may refuse, cancel, or refund any order at our discretion, including where an order or account suggests intended human use. Purchasers are responsible for compliance with the laws that apply where they are located.

4. Pricing and payment

Prices are as listed at checkout in USD. Card and ACH bank payments are processed by our payment processor, 3thix, on its hosted page, which may require identity verification by the processor before a payment completes; card and bank account details are never received or stored by this site. ACH payments are held until the bank transfer clears, typically 3–5 business days, and the order ships after that. Bank-transfer (Zelle) orders are held until the transfer is received and are cancelled if it is not.

5. Returns and guarantee

Physical returns are not accepted. Our documentation and transit guarantees are described on the shipping & guarantee page and are incorporated into these terms.

6. Chargebacks

If you have a problem with an order, contact us first — most issues (wrong item, shipping damage, a documentation dispute covered by the purity guarantee above) are resolved faster and more completely directly than through a card dispute, and are resolved at no cost to you under the guarantees on the shipping & guarantee page. Filing a chargeback without contacting us first, for an order that was accurately described, correctly shipped, and matches its documentation, is treated as a breach of these terms, and we reserve the right to contest it with the card network using order, shipping, and communication records, and to decline future orders from the account or payment method involved.

7. Limitation of liability; indemnity

To the maximum extent permitted by law, PepsMartUSA's liability for any claim arising from an order is limited to the amount paid for the products at issue. You agree to indemnify and hold harmless PepsMartUSA from claims arising from your use, handling, storage, or distribution of products contrary to these terms.

8. Governing law

These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules. Any dispute arising from an order will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
